Alec Baldwin Files To Quash ‘Rust’ Manslaughter Charge, Claims Grand Jury ‘Rigged’

Alec Baldwin is requesting a dismissal from the “Rust” manslaughter case on the grounds that the grand jury that indicted him was unfairly biased against him.

The actor and his lawyer, Alex Spiro, filed fresh court documents that obtained by TMZ. In them, they request that the Santa Fe County District Attorney’s office have his criminal case dismissed entirely on the grounds that the grand jury process was rigged, with the actor claiming that seven extremely biased witnesses were called.

Alec claims that among the witnesses, three were on the D.A.’s “payroll,” two were from the Santa Fe Sheriff’s Office, one was already suing him in a different civil case, and a fourth publicly accused Baldwin of being the cause of ‘Halyna Hutchins’ death a few days later, despite Alec’s assertion that this witness wasn’t involved in the production at the time.

The FBI testing of the weapon used in the incident is another startling statement in the documents. Alec asserts that the D.A. withheld crucial information from that testing, which he says demonstrated the revolver did, in fact, fire when all six rounds were loaded—exactly as it did on the day of the tragedy—without the need to pull the trigger.

Remember that up until now, we had heard the opposite: the FBI’s tests had conclusively shown that the gun could only fire when the trigger was pulled. This is significant as Alec has consistently insisted that he did not pull the trigger.

Alec is requesting that the judge dismiss the involuntary manslaughter accusation because of all these factors. As previously reported, he entered a not guilty plea on this second attempt, following the D.A.’s dismissal of their charges in the first instance.
